Awardly is a software-as-a-service (SaaS) platform that helps government and commercial contractors evaluate bid opportunities. Awardly is operated by Aristrata LLC, a Missouri limited liability company. You can contact us at hello@awardly.app.

2. Information We Collect

Information You Provide

• Account information — your name and email address when you register or sign in.
• Payment information — billing details processed securely by Stripe. We never see or store your full credit card number.
• Company profile data — business name, capabilities, certifications, NAICS codes, set-aside status, and geographic coverage that you enter to personalize your bid analysis.
• Document content — RFP, RFQ, IFB, and other solicitation documents you upload or paste for analysis.

Information Collected Automatically

• Usage data — pages viewed, features used, analysis count, and session timestamps.
• Device and browser data — browser type, operating system, IP address, and referring URL.
• Cookies and local storage — used to remember your session, tier status, and usage count. We do not use advertising cookies.

3. How We Use Your Information

• To provide, operate, and improve the Awardly platform.
• To process your subscription payments through Stripe.
• To authenticate your account through Clerk.
• To send you account-related emails (receipts, password resets, important notices).
• To collect basic profile details when you sign up (your name, company, title, industry, and how you heard about us) so we can understand our customer base and tailor the product.
• To send you our newsletter and occasional product updates — only if you opt in at sign-up or later. We deliver these through Loops (see Section 4), and you can unsubscribe at any time using the link in every newsletter email.
• To analyze document content using AI (via Anthropic's Claude API) and return bid intelligence results to you.
• To track usage limits and enforce subscription tier rules.
• To improve our AI prompts and scoring logic using aggregated, de-identified patterns.

We do not sell your data. We do not use your data to train third-party AI models without your consent.

4. Third-Party Services

Awardly relies on the following trusted service providers:

• Anthropic (Claude API) — processes the solicitation text you submit to generate bid analysis. Anthropic's API data handling is governed by their privacy policy. Submitted text is not retained by Anthropic to train future models under their API terms.
• Stripe — handles all payment processing. We share only your email and subscription tier with Stripe.
• Clerk — manages user authentication. Your email and password are handled by Clerk per their privacy policy.
• Loops — delivers our newsletter and product-update emails. If you opt in to the newsletter, we share your email address, name, and company with Loops to send those messages. Loops' data handling is governed by their privacy policy. You can unsubscribe at any time.
• Cloudflare — hosts our API worker and provides edge security. Cloudflare may process request metadata per their privacy policy.
• Cloudflare Pages — serves the Awardly front-end application.

5. Data Storage and Cloud Sync

Solicitation documents you submit for analysis are processed in real time via Anthropic's Claude API and are not stored on our servers at any point. The original document text is never retained beyond the duration of a single analysis session.

When you save opportunities to your Pipeline, the following pipeline metadata is stored: opportunity name, agency, solicitation number, contract value, due date, status, win probability score, recommendation, and any notes you enter. This data is stored in your browser's local storage on your own device. If you are signed in to an Awardly account, this pipeline metadata is also synced to a secure cloud account hosted on Cloudflare's infrastructure to allow cross-device access.

Important: Do not enter Controlled Unclassified Information (CUI), classified information, awarded contract performance data, pre-decisional procurement documents, NDA-protected materials, or any non-public sensitive information into Awardly — including into notes and comments fields. Awardly is designed for use with publicly posted solicitations only and is not authorized, certified, or designed to process CUI or any controlled information.

6. CUI, CMMC, and Regulated Environments

Awardly is a bid intelligence tool designed exclusively for analyzing publicly posted solicitations — documents that are intentionally made available to the public through SAM.gov, state procurement portals, or other public channels. Publicly posted solicitations are not CUI.

Awardly is not a CUI-authorized system. Our technology stack — including Anthropic's Claude API, Cloudflare Workers, and Cloudflare Pages — is not FedRAMP authorized and has not been assessed for CMMC compliance. Accordingly:

• Users operating under CMMC Level 1, 2, or 3 requirements may use Awardly to analyze publicly posted solicitations, as this does not involve the handling of CUI or FCI.
• Users must not submit any document or information that carries a CUI marking, distribution limitation, or that has been shared under a non-disclosure agreement or other confidentiality obligation.
• Awardly is not appropriate for processing draft solicitations shared outside public channels, awarded contract documents containing performance or pricing data, or any material classified at any level.

Best-Effort CUI Detection

Awardly employs an automated, best-effort screen that attempts to detect common CUI markings, classification banners, FOUO designations, distribution limitation statements, and export-control markings before any document text is transmitted for analysis. When such markings are detected, Awardly will block the submission and display a notification explaining the reason.

This detection is not guaranteed to be comprehensive or error-free. It is a safeguard — not a substitute for user judgment. Users bear primary and sole responsibility for ensuring that no CUI, classified information, or other controlled material is submitted to Awardly, regardless of whether the automated screen triggers. Aristrata LLC accepts no liability for damages arising from a user's submission of controlled or restricted information.

If you receive a CUI block notification and believe it is a false positive (for example, your public solicitation contains the word "controlled" or "confidential" in a standard commercial context), clear the text and re-submit only the public portions of the document. If you have questions about whether a specific document is appropriate to submit, consult your facility security officer (FSO) or compliance officer before proceeding.

7. Third-Party Content and Licensed Data

If you choose to forward or submit content to Awardly that you obtained through a third-party subscription, licensed service, or other agreement (for example, data, notifications, or alerts received under a paid subscription to a third-party opportunity intelligence service), you are solely responsible for ensuring that your use and forwarding of such content complies with the terms of your agreement with that third party.

Awardly makes no representations about the licensing status of user-submitted content and does not verify whether users have authorization to forward, share, or process third-party-licensed materials. Users assume all risk and liability associated with the submission of third-party-sourced content.

8. Data Retention

We retain your account information for as long as your account is active. If you cancel your account, we will delete your personal data within 60 days, except where we are required to retain it for legal or financial compliance purposes (such as transaction records required by IRS or state tax authorities).

Cloud-synced pipeline metadata is deleted within 60 days of account cancellation. Browser-local data is stored on your device and can be cleared at any time through your browser settings.

9. Security

We take reasonable technical and organizational measures to protect your information, including encrypted connections (HTTPS/TLS), server-side API key storage via Cloudflare secrets, and access controls. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

In the event of a confirmed data breach affecting your personal information, we will notify you by email within 72 hours of confirmation, consistent with applicable state and federal breach notification requirements.

10. Your Rights

Depending on your location, you may have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request deletion of your data.
• Opt out of marketing emails at any time via the unsubscribe link.

11. Age Restrictions

Awardly is a professional business tool intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a minor, we will delete it promptly.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or by prominently posting a notice on the platform. Continued use of Awardly after the effective date of any changes constitutes acceptance of the updated policy.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Awardly, operated by Aristrata LLC, a Missouri limited liability company ("Awardly," "we," "us," or "our"). By accessing awardly.app or using any Awardly service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Awardly.

2. Description of Service

Awardly is a SaaS bid intelligence platform that helps government and commercial contractors analyze solicitation documents, score bid/no-bid decisions, extract key compliance data, and manage their bid pipeline. The platform uses AI technology powered by Anthropic's Claude API to generate analysis and recommendations.

Important: Awardly's analysis is for informational and decision-support purposes only. All bid decisions remain solely your responsibility. Awardly does not provide legal, financial, or professional advice.

3. Account Registration

• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to create an account.
• One person or entity may not maintain more than one Free tier account.
• You are responsible for all activity that occurs under your account.

4. Subscription Plans and Payment

Tiers

• Free ($0/month) — Fair-use analyses with opportunity facts only (agency, NAICS, dates, set-aside, contract value, period of performance, scope summary, hard requirement flagging). Go/No-Go verdict, win probability score, pipeline tracking, and exports are locked until upgrade.
• Bronze ($79/month, 14-day free trial) — Everything in Free, plus Go/No-Go verdict, win probability score, scoring reasoning and factor breakdown, and one company profile. Card required at signup; cancel before day 15 to avoid billing.
• Silver ($149/month) — Everything in Bronze, plus full pipeline management, Portal Link watchlist (coming June 12, 2026), wage determination and labor rates, CO and Contracting Officer contact info, submission requirements and portal URL, pre-bid walkthrough details, USASpending intelligence, CSV export, and one company profile.
• Gold ($249/month) — Everything in Silver, plus document parsing (PDF, Word), compliance checklist, Bid Brief PDF, strategic AI recommendations, Capture Planning workflows, BD Events and Team Directory, BD Contacts database, Costing Workbook (WD pre-filled), Award-to-Project Bridge, and up to five company profiles.
• Platinum ($599/month) — Everything in Gold, plus Pipeline Dashboard, team capacity tracking, pipeline value ownership, recompete radar, post-submittal intelligence, loss tracking and debriefs, wage determination lifecycle (decision → project), multi-user access (up to 10 users), and priority support. Includes onboarding.
• Diamond (Enterprise — custom pricing) — Everything in Platinum, plus white-glove deployment, knowledge bases (past proposals, pricing data), proposal assistance (AI-drafted sections), unlimited users, full costing engine, API access, custom integrations, and a dedicated support team. Tailored to your BD process, data sources, and proposal workflow.

Billing

• Paid subscriptions are billed monthly in advance via Stripe.
• Subscriptions auto-renew unless cancelled before the renewal date.
• All prices are in US dollars.
• 7-Day Money Back Guarantee: If you are not satisfied with your paid subscription within the first 7 days, contact us at hello@awardly.app for a full refund — no questions asked.
• After 7 days, subscription payments are non-refundable. You may cancel at any time and will retain access through the end of your current billing period.
• Since Awardly offers a Free tier, we encourage users to evaluate the platform before upgrading to a paid plan.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

5. Acceptable Use

You agree not to:

• Use Awardly for any unlawful purpose or in violation of any applicable laws.
• Submit solicitation documents or other content that you do not have authorization to process, forward, or share.
• Submit content obtained through a third-party subscription or license in violation of that third party's terms of service or license agreement. You are solely responsible for ensuring your use of Awardly complies with any applicable third-party agreements.
• Attempt to reverse engineer, copy, or resell the Awardly platform or its AI outputs.
• Circumvent tier limits, authentication, or usage tracking mechanisms.
• Use automated scripts, bots, or scrapers to access the platform.
• Transmit malicious code, viruses, or any harmful content.
• Use Awardly to facilitate fraud, misrepresentation, bid rigging, improper collusion, or any activity that violates the Procurement Integrity Act (41 U.S.C. §§ 2101–2107), the Sherman Antitrust Act, or other federal, state, or local procurement laws.

6. Intellectual Property

All content, design, code, trademarks, and materials comprising Awardly — including the name "Awardly," the bid intelligence methodology, and all software — are the property of Aristrata LLC or its licensors. Nothing in these Terms grants you any rights to use our trademarks or intellectual property without prior written permission.

The analysis outputs Awardly generates from your submitted documents are provided to you for your internal business use. You may not resell, license, or distribute AI-generated analysis as a standalone product.

7. Data and Privacy

Your use of Awardly is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You represent that you have the right to submit any documents or data you provide to Awardly for processing.

8. Disclaimer of Warranties

AWARDLY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED FROM USING IT.

AI-generated analysis may contain errors, omissions, or inaccuracies. You are solely responsible for verifying all information before making any bid decision.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARISTRATA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to Awardly in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Aristrata LLC and its operators, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, your violation of any third-party agreements (including subscription agreements for opportunity intelligence services), or your infringement of any third-party rights.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of Awardly at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

12. Termination

We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use Awardly ceases immediately. Sections 6, 8, 9, 10, and 13 survive termination.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in St. Louis County, Missouri.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awardly regarding your use of the platform. If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.
